We have substantial expertise in representing major constituents in bankruptcy cases, including debtors, secured creditors, trustees, receivers, creditors’ committees and purchasers in bankruptcy proceedings. We are particularly experienced in the prosecution and defense of fraudulent transfer claims and complex preference issues.

  • As counsel for the debtor-in-possession, we confirmed a chapter 11 plan of liquidation over the objections of creditors who asserted claims exceeding $2 billion, after a contested evidentiary hearing lasting several days. In the same case, we also filed an adversary proceeding against a major publicly traded company and recovered $12 million for the debtor together with a release of all counterclaims against our client. This case involved complex cross-border bankruptcy issues.
  • We represent both lenders and borrowers in loan workouts for non-performing and distressed commercial loans that require judicial intervention.
