OverviewPRACTICE AREAS: Sam Oh is a partner in the litigation group where his practice focuses on commercial litigation and bankruptcy matters. Mr. Oh has broad experience with the Uniform Commercial Code, creditors’ rights and provisional remedies, including writs of attachment, writs of possession, temporary protective orders, turnover orders, temporary restraining orders, preliminary injunctions, and appointment of receivers. He has represented creditors, trustees, debtors and creditors’ committees in all aspects of bankruptcy, including relief from the automatic stay, use of cash collateral, plans of reorganization and liquidation, and avoidance of preferential or fraudulent transfers. As counsel for the debtor in possession in a large chapter 11 case involving complex transnational issues, Mr. Oh confirmed a plan of liquidation over the objections of creditors asserting claims exceeding $2 billion. In the same case, Mr. Oh also filed an adversary proceeding against a major publicly traded company and recovered $12 million for the debtor, together with a release of all counterclaims against the debtor. Mr. Oh served as trial counsel for a major real estate developer in an action by the debtor in possession to obtain post-petition financing secured by a priming lien with priority over the developer’s deed of trust on the debtor’s real property, successfully defeating the debtor’s action. Mr. Oh served as trial counsel for a major commercial lender sued by a borrower for conversion, abuse of process, fraud and interference with contractual relations, successfully defeating all of the borrower’s causes of action. Mr. Oh has spoken at numerous seminars and workshops including: Mr. Oh has served on the Neighborhood Legal Services of Los Angeles County as a Board Member since 1998. Education
