Philip J. Wang is a litigation partner in the San Francisco office. Mr. Wang represents corporations and individuals in a variety of complex litigation matters, including commercial disputes, securities and derivative lawsuits, antitrust matters, and intellectual property disputes. Following his clerkship with a federal district court judge in Detroit, Mr. Wang litigated a wide array of disputes with two of the nation's most prominent litigation departments at Latham & Watkins and Quinn Emanuel.
Representative matters include:

  • Obtained a writ of mandamus - a rare discretionary appeal - before the California Court of Appeals in a race and gender employment discrimination claim on behalf of Kaiser Permanente.
  • Prevailed on multiple motions to dismiss shareholder derivative complaints relating to allegations of options backdating at CNET Networks, Inc.
  • Defended and obtained favorable settlements on behalf Cypress Semiconductor Corporation relating to civil class action antitrust lawsuits relating to SRAM.
  • Defended and obtained favorable settlements for Bear Stearns in multiple class action shareholder lawsuits.
  • Represented CNET in Delaware books and records inspection demand proceedings.
  • Represented leading Chinese solar wafer manufacturer in class action shareholder complaint, internal investigation, and government investigation matters relating to allegations of accounting fraud.
  • Prevailed on motions to dismiss in trade libel cases on behalf of Stembanc, Inc. and its CEO.
  • Obtained summary judgment of non-infringement and invalidity in a patent infringement case on behalf of IBM, which was affirmed by the Federal Circuit.
  • Conducted corporate antitrust and Federal Corrupt Practices Act training around the world for Cypress Semiconductor Corp.
  • Represented Genentech in multi-district patent dispute brought by Columbia University, which resulted in a favorable settlement.
